These terms are a contract between you and SAMTrek UG (haftungsbeschränkt) (“Vaaii”, “we”, “us”). By creating an account, posting a listing, or contacting another member, you accept them. If you do not accept them, do not use Vaaii.
The most important thing on this page: Vaaii introduces people to each other. We never take possession of a parcel, never carry anything, never handle your money, and never inspect what is inside a package. Everything that happens after an introduction is between you and the other member, at your own risk.
Who we are
Vaaii is operated by SAMTrek UG (haftungsbeschränkt), Lerchenstr. 7, 85630 Grasbrunn, Germany. Registered at Amtsgericht München, HRB 309076. Represented by Dr. Shahidul Alam. VAT identification number: DE463689203. You can reach us at info@sam-trek.com or through our contact page.
What Vaaii is, and what it is not
Vaaii is an online noticeboard. Travelers post trips they are already taking and the spare luggage space they have. Senders post parcels they need moved. Both sides can find each other and get in touch.
Vaaii is not:
- a carrier, courier, freight forwarder or logistics company;
- a customs agent or broker;
- a payment provider, escrow service or bank;
- an insurer;
- an employer or agent of any member;
- a party to any agreement you reach with another member.
We do not verify listings, weigh parcels, check identity documents, or confirm that anyone is who they say they are. A listing appearing on Vaaii is not a recommendation or an endorsement.
Who can use Vaaii
You must be at least 18 years old and legally able to enter into contracts. One person, one account. You are responsible for everything done through your account and for keeping your password secure. Tell us promptly if you think someone else has access to it.
You may not use Vaaii on behalf of a commercial courier business without our written agreement.
Your agreement with the other member
When a traveler and a sender agree to move a parcel, that agreement is solely between them. Vaaii is not a party to it and takes no commission from it.
The two of you are responsible for agreeing, in advance and directly:
- exactly what is being carried, and its value;
- the price, and how and when it is paid;
- where and when the handover and the delivery happen;
- what happens if the trip is cancelled, delayed or the item is lost or damaged;
- who pays any duty, tax or customs charge.
We strongly recommend putting this in writing between yourselves before anything changes hands.
Rules for what may be carried
You must not use Vaaii to send, offer to carry, or actually carry any of the following.
Never, under any circumstances
- Illegal drugs, narcotics, and substances controlled under any applicable law, together with drug paraphernalia.
- Weapons, firearms, ammunition, parts of firearms, replica or imitation weapons, knives intended as weapons.
- Explosives, fireworks, flammable liquids and gases, corrosives, radioactive material, toxic or infectious substances, and any other dangerous goods restricted under IATA rules.
- Stolen property, and goods obtained through crime.
- Counterfeit goods and items that infringe someone’s trade mark or copyright.
- Cash, bearer instruments, traveller’s cheques, prepaid cards, and precious metals in bullion form.
- Human remains, body parts, bodily fluids, and biological samples.
- Pornographic material involving minors, and any material whose possession is a criminal offence.
- Ivory, protected wildlife, and anything restricted under CITES.
- Any sealed, wrapped or closed item that the traveler has not personally seen the inside of.
Restricted: legal to own, but heavily controlled at borders
These may only be carried if both members have checked the rules for the specific countries involved, and any licence, declaration or duty is dealt with properly:
- Alcohol and tobacco.
- Prescription medicines, and medicines in quantities above personal use. Carrying someone else’s prescription medication across a border is a criminal offence in many countries.
- Lithium batteries, power banks, and devices containing them, which are restricted in checked luggage.
- Perishable food, meat, dairy and other food subject to import control.
- Live animals, plants, seeds and soil.
- Aerosols, paints, solvents and other pressurised or flammable household goods.
- Drones and radio equipment, which are banned outright in some countries.
Discouraged: allowed, but at your own risk
Vaaii offers no insurance, guarantee or compensation of any kind. We therefore strongly advise against sending:
- Jewellery, watches, precious stones.
- High-value electronics such as laptops, phones and cameras.
- Passports, identity documents, certificates and other irreplaceable papers.
- Antiques, art, and anything of sentimental value that cannot be replaced.
- Fragile items without proper protective packaging.
Both members’ responsibilities
Senders must describe the contents truthfully and completely, hand the item over unsealed so it can be inspected, and declare anything restricted. Deliberately misdescribing a parcel is fraud.
Travelers must personally inspect everything they agree to carry, refuse anything sealed or unclear, and satisfy themselves that the item is legal to take across the specific border in question. If you carry it, you are the person the authorities will hold responsible.
Customs, duties and the law
Import and export rules are your responsibility, not ours. Vaaii does not clear customs, complete declarations, or pay duty on anyone’s behalf, and cannot advise on whether a particular item may cross a particular border.
You are responsible for complying with the laws of the country you leave, the country you arrive in, and anywhere you transit. Penalties for getting this wrong can be severe and can include imprisonment.
Behaviour we do not allow
You may not:
- post false, misleading or duplicate listings;
- impersonate anyone, or use a name that is not yours;
- harass, threaten, defraud or discriminate against another member;
- collect other members’ details for marketing, or send unsolicited advertising;
- attempt to move any conversation off Vaaii in order to evade these rules;
- scrape, copy or republish listings, or use bots against the site;
- interfere with the security or operation of the site.
Suspending or closing accounts
We may remove a listing or suspend an account, with or without notice, where we reasonably believe these terms have been broken, or where a listing appears unlawful or unsafe. We are not obliged to monitor listings, and we do not promise to detect wrongdoing.
You can close your account at any time from your account page or by writing to us. Closing your account does not end obligations you have already taken on with another member.
Fees
Vaaii is currently free to use, and we take no commission on any arrangement between members. If we introduce fees in future, we will tell you in advance and you will be free to stop using the service.
Our liability
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, for fraud, or under the German Product Liability Act.
Subject to that, and because Vaaii is a free introduction service that takes no part in any transaction:
- We are liable without limit for damage caused intentionally or by gross negligence.
- For slight negligence, we are liable only where we breach an obligation essential to the purpose of this contract, and then only for foreseeable damage typical of this kind of contract.
- We are not liable for the acts, omissions, honesty or solvency of any member.
- We are not liable for loss, theft, damage, delay, seizure or confiscation of anything carried.
- We are not liable for payments that members agree between themselves.
- We do not guarantee that the site will be uninterrupted or error free.
Indemnity
If a claim is brought against us because of something you did, something you sent or carried, or because you broke these terms or the law, you agree to cover our reasonable losses and legal costs arising from it.
Changes to these terms
We may update these terms. If a change materially affects you, we will give reasonable notice by email or a notice on the site before it takes effect. Continuing to use Vaaii after that means you accept the new version. The date at the top shows when this version was published.
Law and disputes
These terms are governed by German law. If you are a consumer, you keep the protection of any mandatory rules of the country where you live, and you may bring proceedings in your local courts.
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged, and are not willing, to take part in dispute resolution proceedings before a consumer arbitration body.
If part of this is unenforceable
If any provision is found invalid, the rest continues to apply, and the invalid provision is replaced by one that comes closest to its intended commercial effect.
